1. Who you contract with

Political Window is operated by SPK Holdings LLC ("Political Window," "we," "us"). These terms are the agreement between you and SPK Holdings LLC. If you accept them for an organization, you confirm that you can bind that organization, and "you" means both you and it.

You accept these terms when you create an account, when you subscribe to a paid plan, or when you use the service.

2. The service

Political Window collects and organizes political advertising records: FCC political files filed by broadcast and cable stations, Federal Election Commission filings, state and federal candidate and committee data, digital advertising spend, and rate information extracted from filed documents. We present that material as searchable data, summaries, and analysis.

We are a research and analysis product. We are not a law firm, an accounting firm, a broker, or a compliance authority, and nothing on Political Window is legal, financial, regulatory, or professional advice. Read section 6 before you rely on any figure for a decision that matters.

4. Plans

Political Window offers a free account, a Pro subscription, a one-time Cycle Pass, and Enterprise agreements. What each tier reaches is described on the features and plans page, and we may change what a tier includes as the product develops. If a change materially reduces what your paid plan reaches, section 15 applies.

Enterprise is sold under a separate written order form. Where a signed order form conflicts with these terms, the order form governs for that customer.

5. Billing, automatic renewal, and refunds

5.1 Prices

Prices are in U.S. dollars and exclude any applicable taxes, which we add where required.

The Cycle Pass price is calculated when you start checkout: $399 divided by 30, multiplied by the number of days remaining until Election Day on November 3, 2026, rounded to the nearest dollar, and never less than $399. The price you see on the checkout page is the price you pay. The Cycle Pass is sold only during the election year it covers.

5.2 Automatic renewal — California and everywhere else

Pro Monthly and Pro Annual renew automatically. Before you pay, the checkout page states the price, how often the charge repeats, that it repeats until you cancel, and how to cancel. You agree to those terms as part of paying. After you pay, we send a confirmation email that repeats the plan, the price, the renewal frequency, the date of the next charge, the cancellation policy, and a direct link to cancel.

Pro Monthly: we charge $399 on the same day each month. Pro Annual: we charge $4,390 on the same date each year. Each charge is made to the payment method on file, at the price then shown for your plan, and it continues until you cancel.

The Cycle Pass is a one-time purchase. It does not renew and we do not charge you again for it.

5.3 How to cancel

You can cancel a subscription at any time, online, in as few steps as it took to subscribe:

Cancellation stops the next renewal. Your Pro access continues until the end of the period you have already paid for, and then the account returns to the free tier. We do not delete your account when a subscription ends; see section 8 for deletion.

5.4 Failed payments

If a renewal charge fails, our payment processor retries it and emails you. If the retries do not succeed, the subscription cancels and the account returns to the free tier. We do not run a separate grace period beyond those retries.

5.5 Refunds

Charges are for the period or pass you bought, and we do not refund partial periods or unused time. Cancelling stops future charges rather than reversing past ones. The Cycle Pass is a one-time purchase and is not refundable.

We do refund a charge that should not have happened: a duplicate charge, a charge after a cancellation we received, or a charge at the wrong price. Write to info@politicalwindow.com and we will correct it.

Nothing here limits a refund or cancellation right you have under the law where you live.

5.6 Price changes

We may change prices. A change to the price of a renewing subscription takes effect at your next renewal, and we email you at least 30 days before that renewal so you can cancel first. A price already paid does not change.

6. Data accuracy — read this section

6.1 The data is provided as is

Political Window is provided "as is" and "as available," and the data in it is provided without any warranty of accuracy, completeness, currency, or fitness for any purpose. We assemble records from public sources and from documents filed by third parties. We do not control those sources, we do not audit them, and we cannot promise that what they filed is right.

6.2 Figures are extracted automatically

Much of what you see — rates, dollar amounts, spot counts, flight dates, advertiser and agency names, station and market identifiers — is extracted from PDF documents by automated systems, including optical character recognition and machine-learning models. Automated extraction is probabilistic. It misreads figures, mis-associates a line with the wrong contract or the wrong entity, transposes digits, drops rows from long tables, and produces confident output that is wrong. Coverage is also uneven: for some stations and periods we hold far fewer extracted line items than the underlying filings contain, so a total computed from line items can understate what was actually invoiced.

Entity resolution — deciding that two differently spelled names are the same candidate, committee, agency, or advertiser — is also automated, and it both merges records that should stay separate and separates records that should merge.

6.3 Verify against the source document before you rely on it

Every extracted figure links to the source document it came from. Before you rely on any figure — in a filing, a rate negotiation, a media plan, a complaint, a pleading, a client deliverable, or a public statement — open the source PDF and confirm the figure against it. The source document is authoritative. Our extraction of it is not. Where they disagree, the source document is correct and our record is wrong.

6.4 Rate variance findings are observations, not determinations

Political Window compares filed rates and flags a variance — a difference between rates we extracted for comparable inventory in a comparable period. A variance is an observation produced by software from imperfect data. It is not a legal conclusion, a finding of non-compliance with the lowest-unit-charge rules or any other rule, an accusation against any station, agency, candidate, or committee, and it is not evidence. A variance often has an ordinary explanation that the filed documents do not show, including daypart, program, package terms, make-goods, preemption and clearance, or a correction filed later.

Do not present a variance from Political Window as a finding of wrongdoing. If you intend to act on one, verify it against the source documents under section 6.3 and take your own professional advice.

6.5 Timing

Data is refreshed on a schedule and lags the underlying filings. We do not promise that any figure reflects the current state of a filing at the moment you read it, and a record can change or be removed after you have seen it.

7. Acceptable use

Do not:

Reasonable, attributed citation of individual figures in reporting, filings, or analysis is fine and is not "redistribution." Reproducing the database is not.

We may suspend or close an account that breaks these rules. Where the breach is not serious and can be fixed, we will tell you first and give you a chance to fix it.

8. Your data and ours

Ours. The service, its software, its interfaces, its compilations, and its derived analysis are owned by SPK Holdings LLC or its licensors. Underlying public records are not owned by anyone; our selection, extraction, structuring, and presentation of them are. While your plan is active, you have a non-exclusive, non-transferable right to use the service and its output for your own or your organization's internal business purposes, subject to section 7.

Yours. You keep whatever you submit. You grant us the right to host and process it to run the service. We handle personal information as described in our Privacy Policy, which is part of these terms.

Deletion. Ask us to delete your account and its personal information by emailing info@politicalwindow.com from the address on the account. We handle the request as the Privacy Policy describes. Public records held in the service are not personal data about you and are not deleted by such a request.

9. Third-party services

Payments are processed by Stripe. We do not receive or store your full card number. Your use of the checkout and billing portal is also subject to Stripe's terms and privacy notice. We use other processors to host the service, send email, and measure usage; the Privacy Policy lists them by category.

The service links to documents and sites we do not control, including the FCC public inspection files and Federal Election Commission systems. We are not responsible for them.

10. Disclaimer of warranties

To the fullest extent the law allows, the service and all data in it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any data, figure, total, match, or variance in the service is accurate, complete, or current. No statement we make, in the product or anywhere else, creates a warranty.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, or the cost of substitute services, even if it was told such damages were possible.

Each party's total liability arising out of or relating to these terms or the service, for all claims combined, is limited to the amount of fees you paid to us for the service in the twelve months immediately before the event that gave rise to the claim. If you paid us nothing in that period, our total liability is limited to one hundred U.S. dollars ($100).

This limit applies to every theory of liability, including contract, tort, negligence, strict liability, and statute. It does not limit liability that cannot be limited by law, and it does not limit your obligation to pay fees you owe.

You accept this allocation of risk knowingly. The price of the service reflects it. Given section 6, decisions with financial, legal, or regulatory consequence must rest on the source documents and your own professional judgment, not on our output.

12. Indemnity

You will defend and indemnify SPK Holdings LLC against third-party claims, and the resulting losses and reasonable legal costs, that arise from your use of the service in breach of section 7, or from your publication or other use of output from the service.

13. Term, suspension, and termination

These terms apply while you have an account. You may close your account at any time. We may suspend or close an account for a breach of these terms, for non-payment, or if we are required to. If we close a paid account without cause, we refund the unused portion of what you have paid.

Sections 6, 8, 10, 11, 12, 14, and this sentence survive termination.

14. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The state and federal courts in Los Angeles County, California have exclusive jurisdiction, and both parties consent to venue there.

Before filing anything, email info@politicalwindow.com describing the dispute. The parties will try in good faith to resolve it for 30 days.

Nothing here prevents you from bringing a claim in small claims court, or from reporting a matter to a regulator.

15. Changes to these terms

We may update these terms. We post the updated version here with a new date. If a change materially reduces your rights or what your paid plan reaches, we email the address on your account at least 30 days before it takes effect, and you may cancel before then for a refund of the unused portion of a prepaid term. Continuing to use the service after a change takes effect means you accept it.

Entire agreement, severability, assignment, waiver

These terms and the Privacy Policy are the entire agreement between you and SPK Holdings LLC about the service, and they replace any earlier understanding. If a provision is unenforceable, the rest stays in force and the provision is narrowed to the least extent needed. You may not assign these terms without our written consent; we may assign them to a successor of our business. A failure to enforce a provision is not a waiver of it. There are no third-party beneficiaries.
